RESOLVED that the Minutes of the meeting held on 21 April 2010 be signed as a correct record.

*57 Development Management Committee - Start Time

It was agreed that future meetings of the Development Management Committee should start at 2.00pm (instead of 2.15m).

*58 County Matter: Waste Disposal

(a) Teignbridge District: Application to Consolidate, Retain and Regularise and Make Permanent the Existing In-vessel Composting Facility at Heathfield Integrated Waste Management Facility, John Acres Lane, Kingsteignton

(Councillors Clarance, Smith and Walters declared personal interests by virtue of being members of Teignbridge District Council s Development Control Committee)

Further to Agenda Item 4(a), the Executive Director of Environment, Economy and Culture (EEC/10/106/HQ - text only | pdf supplementary information EEC/10/106/HQ) reported the receipt on 1 June 2010 of a direction from the Secretary of State for Communities and Local Government that the County Council should not approve the application until he had decided whether the applicant would be required to submit an Environmental Impact Statement. In the circumstances consideration of the application was deferred until a future meeting.

(b) South Hams District: Proposed Provision of Agricultural Building for Agricultural Waste Recycling together with Yard for Parking/Turning and Improvement of Track for Access with Visibility Improvements, Channer Wood Plantation, Marley Head, South Brent

(Councillor Pennington attended and spoke in accordance with Standing Order 25(2))

The Committee considered a report by the Executive Director of Environment, Economy and Culture (EEC/10/107/HQ - text only | pdf supplementary information EEC/10/107/HQ) on a planning application for the construction of a building for use as a waste transfer facility for agricultural waste plastic, to be located within a plantation at Channer Wood, Marley Head, South Brent. The report incorporated the findings of the site visit and site meeting held on 30 April 2010.

The Executive Director of Environment, Economy and Culture reported that:

an update of the Ecological Impact Assessment undertaken in 2007 had now been received which confirmed that the site had no particular value;

in the light of the updated EIA, Rattery Parish Council now supported the application.

It was MOVED by Councillor McInnes, SECONDED by Councillor Knight and

RESOLVED that planning permission be refused for the following reasons:

(i) The proposed development would result in inappropriate development in the countryside contrary to the provisions of Policy SHDC3 of the South Hams Local Plan and Policy CS1 of the South Hams Core Strategy;

(ii) The proposed development would harm the visual amenity of the area and lead to potential harm to nature conservation interests, contrary to the provisions of Policies WPP4 and WPP15 of the Devon County Waste Local Plan; and

(iii) There is no overriding need for the development in this location that would outweigh the harm identified in reasons (i) and (ii) above.

(c) Teignbridge District: Importation of Inert Subsoil and Topsoil to Provide a Growing Medium Suitable for Agricultural Restoration to the Former Dainton Landfill, Wrigwell Estate, Ipplepen

(Councillors Clarance and Walters declared personal interests by virtue of being members of Teignbridge District Council s Development Control Committee. Councillor Smith declared a personal interest by virtue of being a member of Teignbridge District Council s Development Control Committee and Ipplepen Parish Council)

The Committee considered a report by the Executive Director of Environment, Economy and Culture (EEC/10/108/HQ - text only | pdf supplementary information EEC/10/108/HQ) on a planning application for the importation of soils in order to restore a former landfill.

The Executive Director of Environment, Economy and Culture reported that Ipplepen Parish Council now supported the application.

It was MOVED by Councillor Wragg, SECONDED by Councillor Radford and

RESOLVED that a site visit be held by the Chairman, Vice-Chairman and local County Councillor on Wednesday 23 June 2010.

(d) Teignbridge District: Proposed Composting of Shredded Garden Waste, Land at Crablake Field, Exwell Barton Farm, Powderham

(Mr Pope - Applicant - and Mr Kendrick - Objector - attended and spoke under the Council s Public Participation procedures)

The Committee considered a report by the Executive Director of Environment, Economy and Culture (EEC/10/109/HQ - text only | pdf supplementary information EEC/10/109/HQ) on a planning application for the composting of green waste at Crablake Field for use on Exwell Barton Farm, Powderham.

The Executive Director of Environment, Economy and Culture reported on proposed changes to the conditions regarding hours, numbers of deliveries and vehicle routeing.

An e-mail from Councillor Connett, the local County Councillor, was circulated at the meeting.

It was MOVED by Councillor Diviani, SECONDED by Councillor Walters and

RESOLVED that subject to the applicant first entering into a legal agreement to secure vehicle routeing to and from the site, planning permission be granted subject to the conditions set out in Appendix II to the report, as amended to reflect the proposed changes necessary to Conditions 2 and 4 (hours and numbers of deliveries), the deletion of Condition 8 (Vehicle Routing) and the inclusion of a condition to prevent the loss of Cirl Bunting habitat.

*59 County Matter: Minerals

(a) North Devon District: Review of Old Mineral Permissions [ROMPs] relating to Plaistow Quarry, Muddiford, Barnstaple

The Committee considered a report by the Executive Director of Environment, Economy and Culture (EEC/10/110/HQ - text only | pdf supplementary information EEC/10/110/HQ) on an application by Hanson Quarry Products Europe Ltd (Hanson) for new conditions to be attached to the existing permissions at Plaistow Quarry, pursuant to the requirements of Section 13 the Environment Act 1995 (Review of Old Mineral Permissions - ROMPs).

It was MOVED by Councillor McInnes, SECONDED by Councillor Diviani and

RESOLVED

(i) that the schedule of conditions amended by the County Council (as set out in Appendix II to the report) be approved;

(ii) that the applicant be advised that the County Council considers that the amended conditions are not such as to prejudice adversely to an unreasonable degree the economic viability of operating the site or the site s asset value.

(b) Alternative Development at Pinhoe Quarry, Harrington Lane, Pinhoe, Exeter

The Executive Director of Environment, Economy and Culture reported on proposed arrangements for dealing with non-mineral development proposals at the former Pinhoe Quarry at Harrington Lane, Pinhoe which had been agreed with Exeter City Council.

An e-mail from Councillor Spence, the local County Councillor, was circulated at the meeting.

It was MOVED by Councillor Knight, SECONDED by Councillor Clarance and

RESOLVED that Exeter City Council deals with the pre-application enquiries for non-mineral development, and with any future non-mineral development planning application at the quarry in accordance with the provisions of Section 101 of the Local Government Act 1972.

*60 County Council Development

(a) Torridge District: Proposed Construction of a New Pre-School Building, Associated Outdoor Play Area, Car Parking and Construction of a Replacement Primary School Hard Play Area at Winkleigh County Primary School, Farmer Franks Lane, Winkleigh

(Councillor Robinson declared a personal interest by virtue of being a member of Torridge District Council)

The Committee considered a report by the Executive Director of Environment, Economy and Culture (EEC/10/111/HQ - text only | pdf EEC/10/111/HQ) on a planning application for a pre-school building with associated outdoor play area and car parking at Winkleigh County Primary School, Farmer Franks Lane, Winkleigh.

The Executive Director of Environment, Economy and Culture:

reported the views received from Councillor Boyd, the local County Councillor;

commented in detail on an e-mail of representation (incorporating questions and photographs) from Mr and Mrs Cole of Sedgetts, Farmer Franks Lane, Winkleigh which had already been circulated to Committee members.

It was MOVED by Councillor McInnes, SECONDED by Councillor Knight and

RESOLVED that pursuant to the provisions of Regulation 3 of the Town and Country Planning General Regulations 1992, planning permission be granted in accordance with the conditions contained in Appendix II attached to the report.

(b) North Devon District: Construction of Single Storey Youth Centre and Associated Works, Tennis Courts, Mill Street, South Molton

(Councillor Edgell declared a personal interest by virtue of being a member of North Devon Council)

(Councillor Yabsley attended and spoke in accordance with Standing Order 25(2))

The Committee considered a report by the Executive Director of Environment, Economy and Culture (EEC/10/112/HQ - text only | pdf EEC/10/112/HQ) on an application for the construction of a new Youth Centre to replace the existing provision which was based at South Molton Community College.

It was MOVED by Councillor Knight, SECONDED by Councillor Walters and

RESOLVED that planning permission be granted subject to the conditions set out in Appendix II to the report.

(c) Torridge District: Proposed Construction of a New Pre-School and Associated outside Play Area, New Access and Three Parking Spaces including one Disabled Space at Field adjacent to Northam St George's C. of E. (VA) Infant School, Jackets Lane, Northam, Bideford

(Councillor Robinson declared a personal interest by virtue of being a member of Torridge District Council and Northam Town Council)

The Committee considered a report by the Executive Director of Environment, Economy and Culture (EEC/10/113/HQ - text only | pdf EEC/10/113/HQ) on a planning application for a new pre-school building with associated outdoor play space and car parking on part of the playing field adjacent to Northam St George s C. of E. Infant School, Jackets Lane, Torrington.

It was MOVED by Councillor Robinson, SECONDED by Councillor Edgell and

RESOLVED that, subject to confirmation from the Government Office for the South West that it does not wish to call in the application for determination, pursuant to the provisions of Regulation 3 of the Town and Country Planning General Regulations 1992, planning permission be granted subject to the conditions contained in Appendix II attached to the report.

(d) Mid Devon District Council: Proposed Construction of a New Library and Community Hub on the Site of Former Health Centre, Fore Street, Cullompton

Further to Agenda Item 6(d), the Executive Director of Environment, Economy and Culture reported that the application for a new library building in Fore Street, Cullompton had not yet been submitted and that therefore the proposal for a site visit was premature.

The Committee received and noted a schedule of action taken by the Executive Director of Environment, Economy and Culture under delegated powers (EEC/10/114/HQ - text only | pdf EEC/10/114/HQ).

*62 Update Report on the Outcomes of Previous Strategic Planning/Highway Consultation Responses made by the County Council's Development Management Committee

The Committee received and noted a schedule setting out the present position regarding decisions by the District Councils and others in respect of strategic planning/highway consultations which it had previously considered (EEC/10/115/HQ - text only | pdf EEC/10/115/HQ).
