5. County Matter - Waste

(a) Teignbridge District: Ruby Farm, Abbotskerswell - Update

Ruby Farm has a long planning history and has been the subject of numerous reports and updates to this Committee. The most relevant background to this update is that Devon County Council considered that the landfill was complete and served an Enforcement Notice in 2008 requiring the restoration of the site to agriculture by 1 August 2008. A planning application for an extension to the recycling area, and the retention of incinerator building and waste verification building was refused by this Authority. Enforcement Notices were served relating to the use of the land for waste recycling operations, and the operator lodged appeals against the two enforcement notices and the refusal of planning permission.

The current situation is that the operator has withdrawn from the two enforcement appeals and planning appeal, and has withdrawn the environmental permit application for the landfill. The operator now proposes that the landfill is restored, and also proposes to submit a planning application to allow for permanent recycling and waste transfer operations to take place at the site.

With regard to the way forward at this site, it is suggested that no further action be taken on the over-tipped, and restored part of the landfill site on the basis that this area is now back in agricultural production. However, it is essential to ensure that the restoration of the landfill is achieved within a reasonable timescale. It is also considered necessary to secure the cessation of recycling operations at the site following the completion of the landfill.

7. Strategic and Highway Consultation

(a) East Devon District: Outline Application for the Development of a Science Park with 76,450m of B1(A -C) uses including a 150 Bed Hotel and Conference Facility and Ancillary Uses (A1, A3, D1 and D2), plus Associated Infrastructure including new Highways Access on Lane East of M5 at junction 29, and adjacent to the A30 Trunk Road

Devon County Council has submitted an outline application for Exeter Science Park (ESP) on 28.5 hectares of land immediately to the east of Junction 29 of the M5 Motorway, being accessed by the A30 to the south. East Devon District Council has now sought the views of this Authority as both Strategic Planning and Highway Authority. It is anticipated that a full Report setting out the consultation response will be presented to the meeting of this Committee on 2 September next.

In view of the significance of this application it is recommended that Members visit the site in order for them to better appreciate the issues when the Report is received. In addition, related planning applications are expected shortly for determination by this Authority in respect of a proposed new bridge over the motorway at the end of Blackhorse Lane to enable direct footpath and cycle linkage to Exeter; and for the internal road network throughout ESP. It is further recommended that Members take the opportunity to examine these aspects of the overall development when they visit the site.
